This summary is provided for your convenience and has no contractual value: the articles below prevail.
Article 1 — Purpose and scope
These conditions govern accommodation bookings entered into directly with Hôtel Bleu Émeraude, operated by SNC Hibiscus, 240 boulevard de Grand-Case, 97150 Saint-Martin, whether made by telephone, by e-mail or on the website www.bleuemeraude.com.
Every booking implies acceptance of these conditions, which are brought to the guest's attention before the deposit is paid.
They do not apply to bookings made through a travel agency or a distribution platform, which are governed by article 13.
Article 2 — Booking and confirmation
The booking is formed by the guest's agreement on the dates, the accommodation category and the price, followed by payment of the deposit provided for in article 4.
A written confirmation is sent to the guest. It states the booking number, the dates, the category, the number of guests, the total amount, the deposit charged and the balance to be settled on arrival.
The guest is asked to check these details and to report any error without delay. The confirmation is binding between the parties.
Article 3 — Prices
Prices are expressed in euros, per unit and per night. They include continental breakfast and wifi access.
To the accommodation price are added the tourist tax, at the rate of 4 %, collected on behalf of the Collectivité de Saint-Martin, and the service charge, at the rate of 11 %.
The total amount, tourist tax and service charge included, appears on the quotation and on the booking confirmation. That is the amount payable.
Services consumed on site and not included in the stay are settled on departure.
Article 4 — Payment terms
At the time of booking, a deposit equal to 30 % of the accommodation price, excluding tourist tax and service charge, is charged to the guest's payment card. This payment confirms the booking. The sums so paid constitute arrhes within the meaning of article L.214-1 of the French Consumer Code.
The balance — that is, the total amount of the stay, tourist tax and service charge included, less the deposit — is settled on arrival, at the hotel's front desk. No charge is made between payment of the deposit and arrival.
The details of the card used at the time of booking are retained, under the conditions of article 15.3, until the stay has been paid in full. By paying the deposit, the guest expressly authorises the hotel to charge to that card any sums remaining due under articles 5 and 6.
Where the booking is made less than thirty days before the arrival date, there is no free-cancellation period: the booking is firm as soon as the deposit is charged.
If the deposit cannot be charged, the hotel informs the guest, who has five days to put the matter right. Failing that, the booking is cancelled.
Visa and Mastercard are accepted. American Express is not. For the communication of card details, the hotel prefers a telephone conversation.
Article 5 — Cancellation by the guest
Any cancellation is notified in writing to info@bleuemeraude.com and takes effect on the date the message is received.
Up to the thirtieth day before the arrival date, cancellation is free and the deposit is refunded in full, within fourteen days, to the card used at the time of booking. This refund is granted by the hotel even though the arrhes regime would allow it to retain the sum.
From the thirtieth day before the arrival date, the booking is firm and the accommodation price remains payable. The sums paid no longer constitute arrhes but payment for the stay.
In that case, the tourist tax and the service charge are not payable, no stay having taken place. The hotel charges the balance of the accommodation price to the card on file, after sending the guest written notice stating the amount, the date of the charge and the last four digits of the card concerned.
Where the cancellation results from a serious and documented event — hospitalisation, death of a close relative, cancellation of the flight by the carrier —, the guest is invited to write to the hotel enclosing supporting evidence. The hotel considers each request and seeks a solution, most often postponement of the stay, subject to availability; the price is then recalculated at the rate applicable to the new dates and the difference remains payable by the guest.
Article 6 — No-show
A guest who does not arrive and has not cancelled is deemed to have cancelled on the arrival date. The accommodation price remains due to the hotel and is charged under the conditions of article 5.4.
The tourist tax and the service charge are not payable.
The accommodation is returned to sale at noon on the day following the scheduled arrival date, unless the guest has informed the hotel of a delayed arrival.
Article 7 — Changes by the guest
Up to the thirtieth day before arrival, the dates, the category or the number of guests may be changed subject to availability. The price is recalculated at the rate applicable to the new dates and the deposit is carried over to the amended booking. The free-cancellation period is then assessed by reference to the new arrival date.
From the thirtieth day before arrival, the booking being firm, no change may be claimed as of right. The hotel may nevertheless grant, as a commercial gesture, postponement of the stay to dates falling within eighteen months, subject to availability and to the difference in rate, which remains payable by the guest.
A postponed stay remains firm: the sums paid cannot give rise to a refund.
Article 8 — Impediment on the hotel's side
If the hotel is unable to provide the accommodation booked, it offers the guest accommodation of an equivalent or higher category, within the property or in a nearby property of at least equivalent category.
The difference in price and the transfer costs are borne by the hotel.
If the guest declines the solution offered, or if the hotel is not in a position to offer one, all sums paid are refunded within fourteen days.
Article 9 — Hurricane events and airport closure
This article applies as soon as Météo-France places Saint-Martin under a hurricane alert for a period covering all or part of the dates of the stay. The alert level published by Météo-France, which is dated and archived, alone determines the applicable regime: no other evidence is required from the guest.
Red alert, "protect yourself", or purple alert, "stay indoors": the guest chooses freely between postponing the stay, free of charge, to dates falling within eighteen months, subject to availability and to the difference in rate, and a full refund of the sums paid, within fourteen days.
The regime of article 9.2 also applies, whatever the alert level in force, if Princess Juliana International Airport (SXM) or Grand-Case Espérance Airport (SFG) is closed to commercial passenger traffic on account of that event, or if the guest's flight is cancelled by the carrier for the same reason.
Measures ordered by the representative of the French State in Saint-Martin — confinement, evacuation, closure of premises open to the public — have the same effects as a red or purple alert.
If the event occurs once the stay has begun, the refund covers the nights not taken. If the guest is unable to leave on the scheduled date, the hotel endeavours to extend the stay at the rate of the original booking, subject to availability and to the safety of the property.
Article 10 — Cancellation insurance
The hotel does not sell cancellation insurance.
It recommends that the guest take out cover with their own insurer, with the issuer of their payment card — many cards include such cover — or with a travel insurer. Such policies generally cover the situations that these conditions do not allow to be refunded.
Article 11 — Arrival and departure
The front desk is open every day from 8:00 to 12:00 and from 15:00 to 18:00. It is closed outside those hours.
Check-in takes place from 15:00 to 18:00. Check-out is before 11:00.
The guest is asked to provide their flight number and landing time as soon as the booking is confirmed. If they arrive while the front desk is closed, the hotel sends them in advance the instructions needed to reach their accommodation unaided. Without flight information, the hotel cannot guarantee key handover outside opening hours.
Article 12 — Occupancy and extra guests
Each unit is booked for a number of guests defined at the time of booking and may not be occupied beyond its capacity: two guests for studios, three for one-bedroom apartments thanks to the sofa bed, four for the two-bedroom apartment. One child under 4 may be accommodated in addition to that capacity, with a crib provided free of charge.
In one-bedroom apartments, the third guest is charged, per night, €90 from the age of 12 and €45 from 4 to 11. The four occupants of the two-bedroom apartment are included in its rate, whatever their age. Children under 4 are accommodated free of charge in every unit.
The hotel may refuse access to guests not declared at the time of booking who exceed the capacity of the unit.
Article 13 — Bookings made through a distributor
Bookings made through a travel agency or a distribution platform are governed by that intermediary's terms of sale, which the guest accepted with them.
These conditions do not apply to such bookings, in particular as regards deposits, cancellation and refunds.
Any request concerning the conditions, the amounts or the modification of such a booking must be addressed to the intermediary. The hotel remains the guest's contact for the welcome and the conduct of the stay.
Article 14 — Complaints
Any complaint is addressed in writing to info@bleuemeraude.com. The hotel undertakes to reply as promptly as possible.
The hotel is committed to handling every complaint directly with the guest, and to seeking an amicable solution before any other step.
Article 15 — Personal data
The data provided at the time of booking are used for the management of the stay, for invoicing and, where applicable, for sending information about the hotel.
The guest has a right of access, rectification and erasure, exercised by writing to info@bleuemeraude.com.
Card details provided to guarantee the booking are stored securely until the stay has been paid in full. They are used solely for the charges provided for in articles 4, 5 and 6, are not passed on to any third party, and are destroyed once the stay has been settled.
Article 16 — Governing law
These conditions are governed by French law.
They are drawn up in French and in English. In the event of a divergence of interpretation, the French version prevails.
Version in force as of 1 October 2026.
